Terms of service
Last updated: October 2026
OVERVIEW
Welcome to GustavsArchive. Throughout these Terms of Service, the terms “we”, “us” and “our” refer to GustavsArchive.
GustavsArchive operates this online store and website, including its content, features, products and services, to provide customers with a curated shopping experience. Our store is powered by Shopify, which enables us to offer our products and services online.
These Terms of Service, together with our other applicable policies, explain the terms and conditions governing your use of our website and services.
Please read these Terms carefully before using our website or placing an order. By accessing or using our website, you agree to these Terms, subject to any mandatory rights you may have under applicable law.
If you do not agree with these Terms, please do not use our website.
SECTION 1 – ACCESS AND ACCOUNT
You must be legally capable of entering into a binding agreement to place an order through our website.
When using our website or placing an order, you may be asked to provide information such as your name, email address, billing address, shipping address and payment details.
You agree that the information you provide is accurate, complete and up to date.
You are responsible for maintaining the confidentiality of your account credentials and for activities carried out through your account. Please contact us promptly if you believe your account has been accessed without authorization.
We reserve the right to restrict or suspend access to our website where reasonably necessary, including in cases of fraud, misuse or violations of these Terms, subject to applicable law.
SECTION 2 – OUR PRODUCTS
GustavsArchive specializes in curated second-hand clothing and selected designer pieces.
We make reasonable efforts to ensure that product descriptions, photographs, measurements, colors and condition information are accurate. However, colors may appear differently depending on your screen and device settings.
As our products are generally pre-owned, individual items may show signs of previous wear. Any known defects, significant imperfections or relevant condition details should be described in the individual product listing.
Please review the product description and photographs carefully before placing an order. If you need additional information about an item, you may contact us before purchasing.
Product availability is limited and may change without notice. We reserve the right to discontinue products or correct genuine listing errors, subject to applicable law and any orders already accepted.
Nothing in this section limits your statutory rights regarding conformity, defects or inaccurate product descriptions.
SECTION 3 – ORDERS AND CANCELLATIONS
When you place an order, you submit an offer to purchase the selected products.
After placing your order, you will receive an order confirmation by email. The order confirmation and any subsequent communications will provide information about your purchase and its processing.
If we are unable to fulfil an order, for example because an item is unavailable or a genuine pricing or listing error has occurred, we will contact you and arrange an appropriate resolution, including a refund where applicable.
Please check your order and delivery details carefully before completing your purchase. If you need to make a change or cancel an order, contact us as soon as possible. We cannot guarantee changes once an order has been processed or dispatched.
Your statutory cancellation and withdrawal rights remain unaffected by this section.
SECTION 4 – PRICES AND PAYMENT
All prices and applicable shipping charges will be displayed during checkout before you complete your order.
The total amount payable, including applicable taxes and delivery charges, will be shown before you confirm your purchase, except for any additional charges that may lawfully arise separately, such as import duties imposed by the destination country.
We accept the payment methods displayed at checkout. Payments must be successfully processed before an order can be dispatched.
Promotional offers, discount codes and special prices may be subject to additional conditions, which will be communicated where applicable.
We reserve the right to correct genuine pricing errors before accepting an order. If an error affects an order that has already been placed, we will contact you to arrange an appropriate solution in accordance with applicable law.
SECTION 5 – SHIPPING AND DELIVERY
Orders are shipped from the Netherlands.
Our estimated delivery times, shipping methods, applicable charges and other delivery information are explained in our Shipping Policy:
https://www.gustavsarchive.com/pages/shipping
Delivery estimates are indicative and may be affected by circumstances such as carrier delays, customs processing, public holidays and other unforeseen events.
Once an order has been dispatched, tracking information will be provided where available.
For consumer purchases, the risk of loss or damage generally remains with GustavsArchive until you, or a person designated by you other than the carrier, take physical possession of the goods. An exception may apply where you independently engage a carrier not offered by us, as provided by applicable law.
If your order has not arrived within the expected delivery period, please contact us so that we can assist you.
Nothing in this section excludes or limits any rights you may have under applicable consumer protection law.
SECTION 6 – RETURNS AND REFUNDS
Our Return and Refund Policy explains how to request a return, the applicable return conditions and how refunds are processed.
You can contact us at archivegustav@gmail.com to initiate a return request.
For eligible consumer purchases within the European Union, a statutory 14-day right of withdrawal generally applies to online purchases, subject to applicable legal exceptions.
Where applicable, customers are responsible for the direct cost of returning goods if they have been informed of this requirement before purchase. Return requests must be communicated within the applicable period.
Our return policy is available through the relevant policy page on our website.
Nothing in these Terms removes or restricts any mandatory rights you have under applicable law.
SECTION 7 – SECOND-HAND ITEMS AND PRODUCT CONDITION
As GustavsArchive primarily sells pre-owned clothing, products may have signs of wear consistent with their age and previous use.
We aim to describe each item's condition accurately and disclose known material imperfections in the product listing.
Please refer to the individual product description and photographs for details about the item you are purchasing.
Second-hand status does not remove your statutory consumer rights. If an item does not conform to its description or has a defect for which we are legally responsible, you may be entitled to an appropriate remedy under applicable law.
SECTION 8 – INTELLECTUAL PROPERTY
All original content on our website, including our branding, logos, text, graphics, photographs and website design, is owned by GustavsArchive or used with permission and is protected by applicable intellectual property laws.
You may use our website for personal, lawful purposes. You may not reproduce, distribute, modify or commercially exploit our original website content without prior written permission, unless permitted by law.
Third-party trademarks, including designer brand names and logos shown in product listings, remain the property of their respective owners. Their appearance on our website is intended to identify the relevant products or brands and does not imply that GustavsArchive is affiliated with or endorsed by those brands.
SECTION 9 – THIRD-PARTY SERVICES AND LINKS
Our website may contain links to third-party websites or use services provided by third parties, including payment providers, shipping companies and other service providers.
These third parties may operate under their own terms and privacy policies. We encourage you to review those policies when using their services.
We are not responsible for the independent operation of third-party websites, except where responsibility cannot lawfully be excluded.
SECTION 10 – RELATIONSHIP WITH SHOPIFY
GustavsArchive uses Shopify to operate its online store.
Your purchase is made directly from GustavsArchive, not from Shopify. Shopify provides the technology that enables us to offer our online store and process customer transactions.
Nothing in these Terms removes any rights or remedies you may have against GustavsArchive or any other party under applicable law.
SECTION 11 – PRIVACY AND PERSONAL INFORMATION
We process personal information in accordance with our Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (GDPR), where applicable.
Information may be processed to fulfil orders, arrange delivery, provide customer support, process payments, prevent fraud and meet legal obligations.
We may share relevant information with service providers where necessary to operate our store and fulfil these purposes.
Please read our Privacy Policy for further details about the information we collect, how we use it and your rights.

SECTION 12 – CUSTOMER FEEDBACK AND REVIEWS
If you submit a review, suggestion or other feedback, you confirm that you have the right to provide that content and that it does not unlawfully infringe the rights of others.
You grant GustavsArchive permission to use your feedback to operate and improve our services and to display or promote genuine customer feedback, subject to applicable law.
We will not use this section to remove your statutory privacy rights or other mandatory rights.
We reserve the right to moderate or remove content where reasonably necessary, including content that is unlawful, fraudulent, abusive or infringes the rights of others.
Any customer reviews displayed on our website must be handled in accordance with applicable rules concerning consumer reviews and misleading commercial practices.
SECTION 13 – ERRORS AND OMISSIONS
We aim to keep all website information accurate and up to date. Occasionally, errors or omissions may occur in product descriptions, pricing, promotions, shipping charges or availability.
If we identify a material error affecting your order, we will contact you and take appropriate action in accordance with applicable law.
We may update website content to correct errors or reflect changes to our products and services. Such updates will not remove rights that have already arisen under an accepted order or applicable law.
SECTION 14 – PROHIBITED USES
You may use our website only for lawful purposes.
You must not use our website to:
-
Violate applicable laws or regulations.
-
Commit fraud or provide deliberately misleading information.
-
Interfere with the security or operation of our website.
-
Upload malicious code or attempt unauthorized access.
-
Infringe our intellectual property rights or those of third parties.
-
Use our website in a way that unlawfully harms other users or our business.
We may take reasonable measures to address misuse, including restricting access where justified and permitted by law.
SECTION 15 – SUSPENSION AND TERMINATION
We may suspend or restrict access to our website where reasonably necessary, including in response to fraud, unlawful activity, security threats or material violations of these Terms.
Any such action will be proportionate to the circumstances and subject to applicable law.
Suspending access to our website does not remove any payment, refund or other obligations that have already arisen.
SECTION 16 – WEBSITE AVAILABILITY
We aim to keep our website available and functioning properly. However, we cannot guarantee uninterrupted access at all times.
Maintenance, technical problems or circumstances beyond our reasonable control may occasionally affect availability.
Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law.
SECTION 17 – LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
In particular, these Terms do not limit your statutory consumer rights concerning defective or non-conforming goods, inaccurate product descriptions, delivery obligations, refunds or other remedies available under applicable law.
To the extent permitted by law, GustavsArchive is not responsible for losses that are not reasonably foreseeable or that arise from circumstances for which we are not legally responsible.
Nothing in this section excludes liability for fraud, intentional misconduct or other matters for which liability cannot lawfully be excluded.
SECTION 18 – INDEMNIFICATION
You are responsible for unlawful use of our website and for losses arising from your deliberate or unlawful infringement of our rights or the rights of third parties.
Nothing in this section requires you to compensate GustavsArchive for losses for which you are not legally responsible, or restricts any mandatory rights you may have as a consumer.
SECTION 19 – SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Any invalid provision will be interpreted or replaced only to the extent necessary to comply with applicable law.
SECTION 20 – ENTIRE AGREEMENT
These Terms, together with the applicable policies referred to on our website and the terms confirmed during checkout, govern your use of our website and your purchases from GustavsArchive.
If any provision conflicts with mandatory consumer protection law, the applicable legal requirement will prevail.
Nothing in these Terms removes rights or remedies that you are entitled to under applicable law.
SECTION 21 – ASSIGNMENT
You may not transfer your rights or obligations under these Terms where doing so would be contrary to applicable law.
GustavsArchive may transfer its rights or obligations where permitted by law, provided that any such transfer does not unlawfully affect your rights as a consumer.
SECTION 22 – GOVERNING LAW
These Terms are governed by the laws of the Netherlands, subject to any mandatory consumer protection provisions that apply in your country of residence.
If you are a consumer residing in another EU Member State, this choice of law does not deprive you of the protection afforded by provisions that cannot be excluded under the law applicable to your situation.
Any dispute will be handled by the competent courts in accordance with applicable law.
SECTION 23 – CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, services or legal obligations.
The latest version will be published on our website with its updated date.
Changes will not retroactively remove rights that you have already acquired under an existing order or applicable law.
Where required, we will notify customers of material changes in an appropriate manner.
